According to the court, the company's medical staff committed “several gross medical errors” during the plaintiff's birth in 2016, as a result of which the child is severely physically and mentally impaired. Despite the poor condition of the unborn girl, no emergency caesarean section was performed, and after the birth she was not adequately monitored or supplied with oxygen.

According to the chamber's findings, the staff also failed to call in the neonatal specialists from Göttingen University Hospital who are available for such cases. Due to the resulting health problems, the plaintiff is unable to eat independently and requires constant care. According to the Göttingen court, the gynecological maternity ward of the defendant hospital has since been closed.
